Join the fight for our members, whose landlord has refused to return their deposit of over £2000!

Initially they were told that it would not be returned until outstanding rent had been paid, but once these arrears were settled the landlord still refused to return the deposit, fabricating a host of flimsy and unprofessional excuses.

It has become clear that the tenants’ deposits may not have been placed in a deposit protection scheme – a legal requirement of any landlord. It has also emerged that the property may lack an HMO license, which ensures adherence to living standards laid out by the council. These are both illegal offences.

Needless to say, this has been a very stressful situation for the tenants and their families. Some of our members are on universal credit and the return of their deposits would be a serious financial boost, and for them to have been denied this for no reason whatsoever has needlessly added to their stress.

Dear Sam Singh,

As a supporter of ACORN, I am writing to you with regard to your failure to return the deposits of  Oscar, Barney, Connor, and Kyran, who formerly rented one of your properties at 46 Jamaica Street, BS2 8JW.
 
When our members moved out of the property in July last year, initially you refused to return their deposit on the grounds that some rent was overdue. However, once the tenants had settled their arrears you persisted in refusing to return their deposit, citing excuses as unprofessional as “we’ve misplaced the paperwork”. The tenants continued to contact you, but you decided to simply ignore them, refusing to return their calls and messages. 
 
Worse still, the tenants have never received confirmation that their deposit was secured in a deposit protection scheme (DPS). Every landlord, as I’m sure you know, is required to place their tenants’ deposit in a DPS by law. A failure to do so is of course illegal. I ask that you provide the tenants with evidence that their deposit is secure and, since you haven’t produced a valid reason for withholding it, that you return it to them immediately.
 
As well as placing your former tenants under needless financial stress, your actions have also had dire consequences for their mental health. In the midst of a devastating pandemic, your actions have intensified and added to their anxiety about employment and the financial stress placed on their families. Quite frankly it is shameful that you have chosen to display such a stubborn lack of compassion at a time when it is most needed.

ACORN demand that you return the tenants’ deposit immediately, and compensate them for the undue financial stress your actions have placed them under.

These are reasonable demands, I ask that you do the right thing and meet them as soon as possible.
