Pay compensation for Emilie's uninhabitable mouldy flat!

Emilie’s landlord forced her to pay six months’ rent up front for a flat which had a serious mould and damp problem from the day she moved in. Emilie’s efforts to work with them to resolve these issues have been met with stalling, inadequate cover up jobs, and attempts to abdicate blame and responsibility. The situation got so bad that Emilie hasn’t been able to live in the flat since 4th January.

By the time Emilie’s lease ends in mid-April she will have been paying rent on a flat she’s not been able to live in for over 3 months. Emilie’s landlord has only offered her a paltry half-month’s rent by way of compensation. That’s not good enough! We’re demanding they pay out for fair compensation - 3 months’ rent, bills and council tax, a full refund on Emilie’s deposit, and for the cost of repairs to Emilie’s belongings made necessary by the state of the flat to be covered.

One of the injustices of private renting is that by herself Emilie lacks the power and leverage to demand to be treated fairly. Fortunately Emilie is a member of Acorn. Let’s show Emilie’s estate agent and landlord that Acorn members can’t be pushed around! By taking action together we have the power to ensure that Emilie is heard and her demands are met.

Dear Simon Chin of Emma Hatton,

As representative of Dorthe Hansen, we demand that you ensure Emilie Bromley, tenant on Withington Road, is justly compensated after her ordeal involving unacceptable, unsafe levels of condensation and mould, dating back to the day she got the keys to your client’s property in October 2020.

As the landlord's agent, time after time you have failed to adequate resolve this situation. Your failures have meant that Emilie has been unable to live in the property since the start of the new year, and is now faced with finding new accommodation on a permanent basis.

Your response to our initial email is less than satisfactory; the results of the damp and timber survey you’ve had carried out in the property this week are completely inconsequential to the compensation Emilie deserves. By midday on Tuesday 6th April, you need to:

- Reimburse Emilie for three months rent, totalling £1785.
- Reimburse bills over those three months, broken down as follows: council tax - £150, gas - £100, water - £75, electricity - £32.
- Ensure that Emilie will receive her full deposit back at the end of her tenancy.
- Ensure that cost of reparations of damage to Emilie’s property will be covered, in the form of professional cleaning of her clothes and soft furnishings due to mould spore infestation.
- Ensure that Emilie receives the positive references she deserves when she has to find a new place to live after leaving this property.
